Terms & Conditions
These Terms and Conditions ("Terms") govern your access to and use of the Campanula application ("Application") for mobile devices, developed and operated by Campanula team ("Service Provider," "we," "us," or "our"). The Application is offered as a Freemium service. By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Application.
License and Restrictions
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application for your personal, non-commercial purposes, subject to these Terms. You shall not: (a) copy, modify, or create derivative works of the Application; (b) reverse-engineer, decompile, disassemble, or attempt to extract the source code of the Application; (c) sell, sublicense, distribute, or otherwise transfer the Application or any rights therein; (d) use the Application for any unlawful purpose. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the exclusive property of the Service Provider.
Subscriptions and In-App Purchases
The Application offers auto-renewable subscription plans that provide access to premium features. By purchasing a subscription, you agree to the following:
- Payment will be charged to your Apple ID account or Google Play account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
- You may manage your subscriptions and turn off auto-renewal in your device's account settings after purchase. For Apple devices, visit Manage your subscriptions on iPhone or iPad. For Android devices, visit Manage your subscriptions on Google Play.
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
- Cancellation of the current subscription period is not permitted. Upon cancellation, you will retain access to premium features until the end of the current billing cycle.
Prices for subscriptions are displayed within the Application and may vary by region. The Service Provider reserves the right to modify subscription pricing. Any price changes will take effect at the start of the next billing cycle following notice of the change.
Platform-Specific Terms
If you download the Application from the Apple App Store, these Terms are supplemented by, and shall be read in conjunction with, Apple's Standard End User License Agreement ("Apple EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict between these Terms and the Apple EULA, the Apple EULA shall prevail with respect to the rights and obligations of Apple.
If you download the Application from the Google Play Store, your use is also subject to the Google Play Terms of Service.
Account Registration and Security
Certain features of the Application require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. The Service Provider strongly advises against jailbreaking or rooting your phone, as such actions may compromise your device's security and may result in the Application not functioning correctly.
Account Deletion
You may request deletion of your account and associated personal data at any time by using the account deletion feature within the Application or by contacting us at support@campanula.app. Upon receiving a valid deletion request, we will delete your account and remove your personal data from our active systems within a reasonable timeframe, except where retention is required by law or legitimate business purposes (such as fraud prevention or resolving disputes). Active subscriptions must be cancelled through your platform's account settings before account deletion; we are unable to process subscription refunds directly.
Weather Data and Accuracy Disclaimer
The Application provides weather forecasts and condition-based alerts sourced from third-party meteorological services, including the Norwegian Meteorological Institute (MET Norway). All weather information is provided on an "as-is" and "as-available" basis. The Service Provider makes no representations or warranties regarding the accuracy, reliability, completeness, or timeliness of any weather data. You acknowledge that weather forecasts are inherently uncertain and should not be relied upon as the sole basis for decisions involving personal safety, property protection, or any other critical activities.
User Content
The Application allows you to create plans, condition rules, and other user-generated content ("User Content"). You retain ownership of your User Content. By creating User Content within the Application, you grant the Service Provider a non-exclusive, worldwide, royalty-free license to store, process, and display your User Content solely for the purpose of providing and improving the Application's services to you.
Third-Party Services
The Application utilizes third-party services that have their own terms and conditions. Below are links to the terms of the third-party service providers used by the Application:
Internet Connectivity and Charges
Certain functions of the Application require an active internet connection. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of Wi-Fi or mobile data access. If you are using the Application outside of a Wi-Fi area, your mobile network provider's agreement terms still apply. You accept responsibility for any data charges incurred, including roaming charges if you use the Application outside of your home territory without disabling data roaming.
Limitation of Liability
The Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of, or inability to access or use, the Application; (b) any conduct or content of any third party on the Application; (c) inaccurate weather data or forecasts provided through the Application; (d) unauthorized access, use, or alteration of your content or transmissions. The Service Provider relies on third parties to provide information, and accepts no liability for any loss arising from reliance on the Application's functionality.
Updates and Termination
The Service Provider may update the Application at any time. You agree to accept updates when offered. The Service Provider may also cease providing the Application and may terminate your access at any time without prior notice. Unless otherwise communicated, upon any termination: (a) the rights and licenses granted to you in these Terms will end; (b) you must cease using the Application and, if necessary, delete it from your device.
Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from or relating to these Terms or the Application shall be resolved in the courts of competent jurisdiction.
Changes to These Terms and Conditions
The Service Provider may update these Terms periodically. We will notify you of any material changes by posting the updated Terms on this page and updating the effective date below. Your continued use of the Application after such changes constitutes your acceptance of the updated Terms. We encourage you to review this page regularly.
